Terms & Conditions

Terms & Conditions

Effective Date: ___________

Welcome to FalconFly!

These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and all related services (collectively, the “Platform”). By accessing or using FalconFly, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to any part of these Terms, please refrain from using our services.

1. Bookings & Payments

1.1 Booking Confirmation
A booking on FalconFly is considered confirmed only after it has been successfully ticketed, not merely upon payment.
In some cases—particularly when a booking is made outside our operating hours (9:00 AM to 9:00 PM IST)—payment may be processed, but the fare may no longer be available by the time we attempt to issue the ticket. If such a situation occurs, we will notify you promptly with revised fare options or arrange a full refund.

1.2 Payment Terms
Full payment is required at the time of booking to secure your reservation. We provide multiple secure payment options, including credit and debit cards, e-wallets, and online banking transfers. All payment transactions are conducted through trusted, PCI-compliant third-party gateways to ensure the highest level of security.
Please note that a booking is only processed once payment has been fully received and validated. FalconFly reserves the right to cancel any reservation if payment fails or is not completed within the stipulated timeframe.

1.3 Price Accuracy
While FalconFly endeavors to display accurate and up-to-date pricing, airline fares are inherently dynamic and may fluctuate due to demand, availability, or other market factors. Prices shown on the Platform are indicative until ticket issuance is completed.
The final fare you pay is locked in only upon successful ticketing. FalconFly is not responsible for any changes, price increases, or discrepancies that may occur due to delays in payment processing or ticket issuance.

2. Accuracy of Information

2.1 Customer Responsibility
It is the customer’s responsibility to provide accurate, complete, and up-to-date information at the time of booking. This includes correct passenger names (as they appear on official travel documents), date of birth, passport details, and valid contact information.

2.2 Consequences of Incorrect Information
Any discrepancies or errors in the information provided may result in boarding denials, fines, or delays. FalconFly is not liable for costs, penalties, or inconvenience resulting from incorrect or incomplete data. All correction-related costs are borne by the passenger.

3. Changes & Cancellations

3.1 Modifications
Changes to travel dates or routes are subject to the fare rules of the airline. Not all tickets may be eligible for modification, and changes may incur additional charges including fare differences and service fees.
Please note:

·       Airline tickets are strictly non-transferable. A confirmed ticket cannot be transferred to another individual under any circumstances.

·       Name corrections are governed by airline-specific policies and may be allowed only in limited cases (such as spelling errors). These changes, if permitted, may incur correction fees as per airline discretion.

3.2 Cancellations
Cancellation policies vary depending on the airline and the fare category selected. Refunds, if applicable, will be processed in accordance with the airline’s terms and conditions.
In the case of medical emergencies or bereavement, customers may submit supporting documents (such as a medical certificate or death certificate) to FalconFly. We will forward these to the airline for consideration.
Important: Refunds in such cases will only be processed if and when approved by the airline. FalconFly has no control over the outcome or decision timeframe.
Refund processing timelines depend entirely on the airline and may take several weeks. FalconFly will release any approved refundable amount to the customer only after it is received from the airline.

3.3 No-Shows
If a passenger fails to show up for a scheduled flight without cancelling in advance, the entire ticket value may be forfeited. No-show penalties are enforced as per airline rules and typically result in the ticket being rendered non-refundable.

4. Liability

4.1 Our Role
FalconFly operates solely as an authorized travel facilitator and booking intermediary. We assist customers in accessing and reserving travel-related services such as flights, hotels, and transportation, which are provided and fulfilled directly by third-party suppliers including airlines and accommodation providers.
While we strive to ensure a smooth and reliable booking experience, we do not operate or control any travel services directly. We are not a principal in the contract for services booked via our platform, and all travel services are subject to the terms and conditions of the respective service providers.

4.2 Third-Party Responsibility
We are not liable for delays, cancellations, baggage loss, or other operational matters handled by airlines or service providers.

4.3 Limitation of Liability
We are not responsible for consequential losses such as missed events, additional expenses, or accommodation costs resulting from travel disruptions. Travel insurance is strongly recommended.

5. User Conduct

5.1 Acceptable Use
You agree to use the FalconFly Platform responsibly and in accordance with applicable laws and these Terms. Usage must be solely for legitimate, personal travel planning and booking purposes.

5.2 Prohibited Behaviour
You must not engage in any activity that may compromise the integrity, security, or performance of the Platform. Prohibited actions include but are not limited to:

·       Deploying bots, scrapers, or automated tools to extract data or disrupt services.

·       Impersonating individuals, using false identities, or misrepresenting your affiliation with any entity.

·       Introducing viruses, malicious code, or attempting to hack or overload our systems.

·       Posting offensive, threatening, or unlawful content, or interfering with the experience of other users.

·       Infringing upon FalconFly’s or any third party’s intellectual property rights.

Violation of these guidelines may result in suspension or termination of access, and legal action where applicable.

6. Intellectual Property
All materials displayed or available on the FalconFly Platform—including but not limited to logos, branding, images, graphics, text, icons, software, and underlying code—are the exclusive property of FalconFly or its licensed content providers.
You are granted a limited, non-transferable, and non-exclusive right to use the Platform for personal travel-related activities only. Any unauthorized reproduction, distribution, modification, or commercial exploitation of our content is strictly prohibited and may result in legal action.

7. Privacy Policy
Your privacy is important to us. By agreeing to these Terms, you also accept our Privacy Policy, which outlines how we collect, use, and protect your personal information.

8. Unaccompanied Minors
Travel for unaccompanied minors (children typically between the ages of 5 and 12 travelling alone) is subject to individual airline policies. Some airlines may allow this only under specific conditions or on certain routes.
FalconFly does not offer special handling services for unaccompanied minors. Parents or guardians must consult the airline directly to understand eligibility, paperwork, applicable fees, and any consent forms required.
We are not liable for denial of boarding or service refusal due to non-compliance with the airline’s unaccompanied minor policy.

9. Travel Requirements
It is your sole responsibility to ensure that you comply with all passport, visa, immigration, and health regulations required by the destination country. This includes obtaining necessary travel documents, vaccinations, and entry permissions well in advance of departure.
FalconFly does not offer legal, immigration, or embassy-related advisory services. We are not liable for any consequences—including denied boarding or entry—arising from failure to meet the entry requirements set by authorities. Please refer to the official government or consulate websites of your destination for the most accurate and current information.

10. Travel Insurance
We strongly advise all travellers to obtain comprehensive travel insurance that covers unexpected events such as flight cancellations, medical emergencies, personal injury, baggage loss, or trip interruptions.
Please note that FalconFly does not provide or sell travel insurance. We are not responsible for any financial losses or inconveniences incurred due to unforeseen circumstances outside our control. Insurance decisions and coverage should be arranged independently and directly through trusted insurance providers.

11. Changes to These Terms
We may revise these Terms at any time. Changes become effective once posted on the Platform. Your continued use of the Platform indicates your acceptance of updated Terms. Please review them regularly.

12. Governing Law
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the competent courts in the city where FalconFly’s registered office is located.
